Samsung Research Terms and Conditions


1. Purpose

(1) These terms and conditions ("Terms and Conditions") govern and regulate the rights, obligations and responsibilities of Samsung Electronics Co., Ltd. (“Samsung”) and of users related the use of the internet-related services (the “service”) provided by Samsung Research website (research.samsung.com) operated by Samsung.

2. Definition

(1) [Samsung Research website (research.samsung.com)] refers to a virtual workplace set by Samsung in order to provide users with goods or services (“goods, etc.”) where transaction of goods, etc. using IT equipment such as computer is enabled, and it also means a business operator managing Samsung Research website (research.samsung.com) as well.

(2)”Users” refer to persons who connect to [Samsung Research website] and use services of [Samsung Research website] in accordance with the Terms and Conditions herein.

3. Acceptance of the Terms and Conditions, explanation, and revision

(1) [Samsung Research website] shall post the Terms and Conditions, its business name, location, and e-mail address on the service screen within [Samsung Research website] in order that users can read thereof, provided that the terms and conditions are shown when users open a screen linked to the page.

(2) [Samsung Research website] shall provide a separate page or a pop-up screen through which users understand important contents such as subscription withdrawal and ask users’ consent before they accept the Terms and Conditions.

(3) [Samsung Research website] may revise the Terms and Conditions within the relevant law and regulations such as Act on the Consumer Protection in Electronic Commerce, etc., Act on the Regulation of Terms and Conditions, Framework Act on Electronic Transactions, Digital Signature Act, Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., Act on Door-to-Door Sales, etc., Framework act on Consumers.

(4) When revising the Terms and Conditions, [Samsung Research website] shall provide a notice of the enforcement date and the reason of revision seven (7) days before coming into force of the new Terms and Conditions (30 days regarding matters unfavorable to users). In this case [Samsung Research website] shall clearly show the difference between existing Terms and Conditions and the revised Terms and conditions.

(5) When revising the Terms and Conditions, the revised Terms and Conditions shall be applied to the contract that will be signed after the enforcement date, and existing Terms and Conditions shall be applied to the contract that is signed before the revision. In the event users of existing contract notify [Samsung Research website] that they want to apply the revised Terms and Conditions within the period specified in the paragraph 4 and receive the consent from [Samsung Research website], the revised Terms and Conditions shall be applied.

(6) In the event a user fail to express their intent to reject the revised Terms and conditions within the period of thirty (30) days after they are informed the user is deeded to have accepted the revised Terms and Conditions.

(7) In the event a user does not accept the application of the revised Terms and Conditions, [Samsung Research website] cannot apply the revised Terms and Conditions and in this case the user can terminate the contract. [Samsung Research website] can terminate the contract if there is a special reason for which the existing Terms and Conditions cannot be applied.

(8) Matters not stipulated in the Terms and Conditions and any interpretation thereof shall comply with Act on the Consumer Protection in Electronic Commerce, etc., Act on Regulation of Terms and Conditions, and Guideline of Consumer Protection in Electronic Commerce stipulated by the Korea Fair Trade Commission and related law and regulations or commercial practice.

4. Provision of service and changes

(1) [Samsung Research website] shall perform:

  • ① Provision of information regarding Samsung Research
  • ② Other services determined by [Samsung Research website]

(2) [Samsung Research website] may change its contents in the event information is changed.

5. Suspension of service

(1) [Samsung Research website] may temporarily suspend provision of services in the event of maintenance, inspection, replacement, malfunction, and disconnection of computer and other information and communication facilities.

(2) [Samsung Research website] shall compensate for damage to users or third parties caused by temporary suspension of the provision of services due to any reason specified in Article 5.(1). If [Samsung Research website] proves the lack of bad or negligence, it has no responsibility thereof.

(3) In the event [Samsung Research website] is no longer able to provide services due to changes in the nature of its business , abandonment of business, integration between companies, it shall notify users using methods in accordance with Article 8. In this case [Samsung Research website] shall compensate for damage to users in accordance with applicable guidelines and law and regulations of [Samsung Research website].

6. Obligations of users

Users shall not:

(1) register false information when applying or changing

(2) steal others’ information

(3) modify information posted on [Samsung Research website]

(4) transmit or post information other than that authenticated by [Samsung Research website]

(5) infringe any copyright and intellectual property of the third party and others

(6) harm the reputation of any third party or disturb business thereof.

(7) publicize or post pornographic or violent messages, video, record, and other information against public order on [Samsung Research website]

7. Relationship between linking website and linked website

(1) In case that [Samsung Research website] and a subordinate website are linked by way of hyperlinks (including text, image, and animation), the former is considered as a linking website and the latter a linked website.

(2) In case that [Samsung Research website] specifies that it is not be liable for any information that a subordinate website independently provides on the entry screen or pop-up screen when linked, it shall not be liable for the transaction.

8. Copyright ownership and limitation of use

(1) Copyrighted works and other intellectual property created by [Samsung Research website] belong thereto.

(2) Users are not permitted to copy, transmit, distribute, broadcast, or commercially use the information that [Samsung Research website] owns copyright thereof, nor can users grant a license to use such information to any third party.

(3) In the event of using copyrighted works which belong to users, [Samsung Research website] shall inform users of that in accordance with the contract.

9. Dispute settlement

(1) [Samsung Research website] shall establish and operate a Help Desk to receive users’ opinion and complaint and deal with compensation to any loss.

(2) [Samsung Research website] shall deal with users’ opinion and complaints as priority. If it is difficult to deal with them promptly, it informs users of the reason and schedule.

(3) When a user applies for remedy to compensate damage caused by electronic transaction disputes between [Samsung Research website] and users, it may resort to a mediation offered by the Fair Trade Commission or other dispute settlement institutions operated at the request of municipal or provincial governments.

10. Jurisdiction and applicable law

(1) Any lawsuits arising out of disputes from electronic transaction between [Samsung Research website] and users will be filed exclusively with the district court in the jurisdiction of the user’s permanent address at the time of suing, or in the absence of a permanent address, the jurisdiction of the user’s temporary address.

(2) Any lawsuits regarding disputes from electronic transaction between [Samsung Research website] and users shall be governed by laws of the Republic of Korea.

*The Terms and Conditions come into force as of March 15, 2018. The Terms and Conditions take effect by way of notification to a user as a posting on the official website and the user’s acceptance thereof.
